1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Motonia, operated by Morobo LLC (US). By creating an account, accessing, or using Motonia, you agree to these Terms, our Privacy Policy, our Community Guidelines, and our Risk & Safety Disclaimer. If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years old to use Motonia. By using the App you represent that you are 18 or older.

3. Safety-Critical Disclaimer

  • Motorcycle riding is inherently dangerous. You assume all risk of riding.
  • Do not view, type into, or otherwise visually or manually interact with Motonia while your vehicle is in motion. Set up your ride, destination, and settings before you ride.
  • You are solely responsible for safe vehicle operation and for compliance with all traffic, distracted-driving, and helmet/communication-device laws in your jurisdiction.
  • Navigation, live-rider positions, voice, and hazard information may be delayed, inaccurate, incomplete, or unavailable. Never rely on them for safety-critical decisions.

4. Features in This Release

This release includes: navigation (Premium), free-ride and Explore modes, live rider visibility on the map, hazard and police reporting/visibility, group rides, proximity voice chat, group voice chat, a community leaderboard (including top speed), and account/social features. Features may change, be added, or be removed over time.

5. Accounts and Security

You are responsible for your account credentials and for all activity under your account. You agree to provide accurate account information and keep it updated.

6. Location Sharing and Live Riders

When you enable live-rider visibility or join a proximity or group session, other users may see your real-time approximate location, username, profile image, motorcycle, and movement. You control this at all times: you can set visibility to All, Friends, or None, and you can leave a proximity or group session at any time. Do not share your location with people you do not trust.

7. Voice Chat (Proximity and Group)

Motonia offers optional live voice chat with nearby riders (proximity) and with members of a ride group (convoy). By using voice chat you agree that:

  • Voice is transmitted live to other participants in real time. Motonia does NOT record, store, or sell your voice audio.
  • You will use voice responsibly and only in a hands-free manner (e.g., a helmet communication system), consistent with your local laws. You are responsible for compliance with all distracted-driving and hands-free laws.
  • You will not transmit harassing, threatening, hateful, sexually explicit, or otherwise objectionable content. There is zero tolerance for objectionable content or abusive behavior.
  • Other participants can mute, block, and report you. Morobo LLC may suspend or terminate accounts for voice misconduct.

8. Hazard and Police Reporting

Hazard and police reports are user-generated, unverified, and shared with other users in the area. They may be inaccurate, outdated, mistaken, or absent. They are provided for general awareness only and are NOT a substitute for obeying the law, paying attention, or exercising your own judgment. You agree not to submit false, malicious, or harassing reports. Morobo LLC does not guarantee and is not liable for the accuracy, presence, or absence of any report.

9. Leaderboard, Speed, and Performance Data

Motonia may display community leaderboards, including a top-speed leaderboard, based on self-reported telemetry from your device. This data is informational only. Motonia does NOT encourage, promote, or reward illegal, reckless, or unsafe riding or speeding. You must obey all speed limits and traffic laws at all times. Any speed or performance figure is for your private record or for use on a legal, closed course only. You are solely responsible for how you ride; Morobo LLC is not liable for any consequence of speeding or unsafe riding.

10. User Content, License, and Moderation

You may submit content such as hazard/police reports, profile details, group/ride information, and live voice. You retain ownership of your content; you grant Morobo LLC a non-exclusive, worldwide, royalty-free license to host, transmit, and display it to operate the App. There is ZERO TOLERANCE for objectionable content and abusive users. Motonia provides tools to report and block other users (including from the live-rider card). We act on reports of objectionable content, typically within 24 hours, and may remove content, limit visibility, and suspend or terminate offending accounts.

11. Acceptable Use

You agree not to misuse Motonia, including: harassment or abuse of other users; hate speech, threats, or sexually explicit content; false or malicious hazard/police reports; impersonation; unauthorized access; scraping; or any illegal activity.

12. Subscriptions and Billing

Motonia is free to use. Voice chat (proximity and group) and group rides are free features. Motonia Premium is an optional auto-renewing subscription that unlocks turn-by-turn voice navigation, free-ride/Explore on the navigation engine, multiple motorcycles in your garage, and other Premium features as they ship. Paid subscriptions are processed through the Apple App Store (and Google Play on Android). Pricing, taxes, renewals, cancellation, and refunds are governed by the applicable store policies at the time of purchase. Morobo LLC does not store or process payment card data. You may cancel your subscription at any time in your Apple ID settings or Google Play account.

13. Termination

We may suspend or terminate access for violations, security concerns, or legal requirements. You may request account deletion by contacting contact@morobo.org, subject to legal retention obligations.

14. No Warranty; Limitation of Liability; Indemnification

Motonia is provided "as is" and "as available," without warranties of any kind. To the maximum extent permitted by law, Morobo LLC disclaims all warranties and limits its liability as described in this document. You agree to indemnify and hold harmless Morobo LLC from claims arising out of your content, your use of the App (including voice chat, location sharing, group rides, and reporting), or your violation of these Terms or any law.

15. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict of laws principles. Disputes will be resolved in the courts of competent jurisdiction in Texas, unless otherwise required by applicable law.
