Pregamify

These Terms of Service ("Terms") govern your access to and use of the Pregamify mobile application ("App") provided by Morobo ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use.

The App offers an optional paid subscription ("Pregamify Pro") that unlocks additional features, including ad-free gameplay, full access to all minigames, higher difficulty tiers, and Endless mode. Current pricing and subscription terms are shown inside the App before purchase.
All purchases are processed by Apple through the App Store. Payment will be charged to your Apple ID account upon confirmation of purchase.
Subscriptions automatically renew at the end of each billing period (weekly, monthly, or annual as selected) at the same price unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription at any time in iOS Settings > your name > Subscriptions. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for the unused portion of a term.
If a free trial is offered, any unused portion is forfeited when you purchase a subscription. If you do not cancel before the trial ends, the subscription will automatically begin and you will be charged.
All refund requests are handled by Apple under their policies at support.apple.com/en-us/HT204084. We do not process refunds directly.
Free users see advertising served by Google AdMob. By using the App as a free user you consent to the display of advertising. Subscribing to Pregamify Pro removes advertising as long as the subscription is active.
Any scores, progress, streaks, or virtual items in the App have no monetary value and cannot be exchanged for cash or any other value. They are stored locally on your device and may be lost if you uninstall the App, reset your device, or if the App is discontinued.
You agree to use the App in compliance with all applicable laws. You are solely responsible for your use of the App and for any consequences of that use.
The App, including all text, graphics, user interfaces, sounds, code, and associated content, is owned by Morobo or its licensors and is protected by United States and international intellectual property laws. Except for the limited license granted in Section 2, no rights are transferred to you.
The App uses third-party services (Apple, Google AdMob, RevenueCat). Your use of the App constitutes acceptance of the applicable third-party terms:
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that defects will be corrected.
The App is a casual game intended for entertainment and general brain training only. It is not a medical or therapeutic product and is not intended to diagnose, treat, cure, or prevent any condition, nor to improve performance in any specific professional, competitive, or real-world activity.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOROBO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. Our total liability for all claims relating to the App shall not exceed the greater of (a) the amount you paid us for the App in the 12 months prior to the event giving rise to liability, or (b) USD $20.
You agree to indemnify and hold harmless Morobo and its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or your misuse of the App.
We may suspend or terminate your access to the App at any time, without notice, for any reason, including violation of these Terms. Upon termination, the license granted in Section 2 ends immediately and you must stop using the App. Sections 5–13 survive termination.
We may update these Terms from time to time. The "Last updated" date at the top of this document reflects the most recent version. Material changes will be announced in the App. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the App shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction there.
These Terms are between you and Morobo only, not with Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
