This End User License Agreement (the "EULA" or "Agreement") is a binding legal agreement between you (the "User", "you", or "your") and Morobo ("Licensor", "we", or "us") concerning your use of the Pregamify mobile application (the "App") and any associated services or content.
By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not use the App.
Subject to your compliance with this EULA, Licensor grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial use.
The App is licensed, not sold, to you. Licensor and its licensors retain all right, title, and interest in and to the App, including all copyrights, trademarks, and other intellectual property rights. No rights are granted except as expressly set forth in this EULA.

The App offers an optional paid subscription service ("Pregamify Pro") that unlocks premium features such as ad-free gameplay, access to premium minigames and difficulty tiers, and Endless mode. Pricing and the list of features included are shown in the App prior to purchase.
All purchases are processed exclusively through the Apple App Store. Payment is charged to your Apple ID at the price confirmed at time of purchase.
Subscriptions automatically renew at the end of each billing period at the price of the current rate at renewal time unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple account is charged for renewal within 24 hours prior to the end of the current period.
You may manage or cancel your subscription at any time via iOS Settings > your name > Subscriptions, or via Apple's account management tools. Cancellation becomes effective at the end of the current paid term.
If a free trial is offered, it begins immediately on purchase. Any unused portion of a free trial will be forfeited if you purchase a subscription to the service. If you do not cancel before the trial period ends, you will be automatically charged for the subscription.
All sales are final and we do not offer refunds directly. Refund requests are handled exclusively by Apple under its policies at support.apple.com/en-us/HT204084.
Non-subscribing ("free") users see advertising served through Google AdMob within the App. By using the App as a free user you agree to the display of advertising, including rewarded video ads that may be presented as an option to continue gameplay or earn in-app bonuses.
Any scores, streaks, stats, badges, or virtual progress in the App are provided for entertainment purposes only. They have no monetary value, may not be traded, redeemed, or exchanged for anything of value, and may be reset, altered, or removed by Licensor at any time.
Pregamify is a casual game intended for general entertainment and recreational brain-training purposes. It is not a medical device, diagnostic tool, or therapeutic product. No claims are made that the App will improve your performance in any specific professional, competitive, academic, or real-world activity, nor that it will diagnose, treat, cure, or prevent any medical or psychological condition.
Licensor may release updates, patches, or new versions of the App from time to time. You may be required to download and install updates to continue using the App. Licensor may add, modify, or remove features of the App at any time without notice. Licensor may also discontinue the App entirely.
This EULA remains effective until terminated by you or Licensor. You may terminate by uninstalling the App. Licensor may terminate your license at any time, without notice, if you breach this EULA. Upon termination, you must cease all use of the App. Sections 2, 6, 7, 10, 11, 12, 13, and 15 survive termination.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by applicable law, Licensor disclaims all warranties, express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. Licensor does not warrant that the App will meet your requirements, be uninterrupted or error-free, or that any defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP. Licensor's total cumulative liability under this EULA shall not exceed the greater of (a) the amounts you paid Licensor for the App in the twelve (12) months preceding the claim, or (b) USD $20.
You agree to defend, indemnify, and hold harmless Licensor and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your breach of this EULA or your use of the App.
This EULA is governed by the laws of the State of Texas, USA, without regard to conflict-of-laws principles. You agree that any action arising from this EULA or your use of the App shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you submit to personal jurisdiction in those courts.
The following applies to the Apple App Store version of the App:
This EULA constitutes the entire agreement between you and Licensor regarding the App and supersedes any prior agreements. If any provision of this EULA is held to be unenforceable, the remaining provisions will remain in full force. Failure to enforce any provision is not a waiver. You may not assign this EULA; Licensor may assign it freely.
