1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Motonia, operated by Morobo LLC (US). By creating an account, accessing, or using Motonia, you agree to these Terms.

2. Eligibility

You must be at least 18 years old to use Motonia.

3. Safety-Critical Disclaimer

  • Do not interact with Motonia while riding.
  • You are solely responsible for safe vehicle operation and compliance with traffic laws.
  • Navigation and hazard information may be delayed, inaccurate, or incomplete.
  • Always prioritize road conditions, signs, and lawful driving/riding behavior over app prompts.

4. Current Release Scope

This release includes live rider visibility, navigation, hazard reporting/visibility, and account features. Proximity chat and group rides are not currently active in this release.

5. Accounts and Security

You are responsible for account credentials and all activity under your account. You agree to provide accurate account information and keep it updated.

6. Acceptable Use

You agree not to misuse Motonia, including:

  • Harassment, threats, hate speech, or abusive conduct
  • False hazard reports or fraudulent safety information
  • Attempting unauthorized access, scraping, reverse engineering, or interfering with service operation
  • Posting illegal, infringing, or deceptive content

7. User Content, License, and Moderation

You may submit content such as hazard reports, profile details, and moderation reports. You grant Morobo LLC a non-exclusive, worldwide, royalty-free license to host, process, and display this content solely to operate, improve, secure, and moderate the service.

We may remove content or restrict accounts that violate these Terms, community rules, or safety requirements.

8. Subscriptions and Billing

Paid features, if offered, are processed through Apple App Store and/or Google Play under their billing rules and subscription terms. Pricing, taxes, renewals, cancellation, and refunds are governed by the applicable store policies.

9. Account Suspension and Termination

We may suspend or terminate access for violations, security concerns, abuse, or legal requirements. You may request account deletion by contacting contact@morobo.org, subject to legal retention obligations.

10. No Warranty (As-Is)

Motonia is provided "as is" and "as available" without warranties of any kind, including accuracy, availability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Morobo LLC and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, business, or goodwill arising out of or related to Motonia.

12. Indemnification

You agree to indemnify and hold harmless Morobo LLC from claims, liabilities, damages, and expenses arising from your use of Motonia, your content, or your violation of these Terms or applicable law.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict of laws principles. Any dispute will be resolved in courts of competent jurisdiction in Texas, unless otherwise required by applicable law.

14. Changes to Terms

We may update these Terms from time to time. Continued use after updates become effective constitutes acceptance of the revised Terms.
